Subject: Protection of Irish heritage
In reference to the answer from Mr. Dimas on behalf of
the Commission on 14th. January 2008 to my question
P-5712/07, what has the Commission done to encourage the
Irish Government, Meath County Council, or the National
Roads Authority to protect and promote their cultural and
archaeological heritage?.

In the context of the M3 motorway project, the Honourable
Member is aware of the action that the Commission has
taken pursuant to Directive 85/337/EEC on the assessment
of the effects of certain public and private projects on
the environment with regard to decisions to remove
archaeological monuments. In particular, it has decided
to refer Ireland to the European Court of Justice with a
view to strengthening Irish legislation in this domain.
The Commission would also refer the Honourable Member to
an earlier case, Case C-66/06, Commission v Ireland,
which is currently pending before the Court and which
concerns the same Directive. The latter case is in part
based on evidence of a high rate of loss of
archaeological monuments due to land improvement projects
which are not required to be assessed under Ireland's
implementing legislation.
