M3: Directions to NRA
Today I've had the opportunity to examine the file in relation to the Lismullin case. My predecessor, Mr. Dick Roche was required to consider and determine an application from the NRA for directions in relation to the national monument (enclosure) at Lismullin, County Meath on the approved route of the M3.
In carrying out this quasi-judicial function, the then Minister followed the procedures prescribed under the National Monuments (Amendment) Act 2004. These included consultation with the Director of the National Museum. Advice from both the Director and the Department's Chief Archaeologist indicated that excavation of the Lismullin enclosure was the preferred archaeological approach: the alternative of leaving the monument in place would inevitably result in its destruction from the elements. Based on this advice, the then Minister required the NRA to fully excavate and record the national monument.
Given that all of the above has occurred, it is not open to me to set aside the recent directions. Without a change in material circumstances affecting this case, there is no basis for amending the quasi judicial determination recently made. I have consulted with the Office of the Attorney General who confirm this position.
I am fully committed to preserving the archaeological heritage of the area. It is my intention to meet with members of the archaeological community next week, and with the Director of the National Museum, to hear their views in regard to any future archaeological finds.
